This policy explains how Avilés Fragrances handles personal information when you use our website, buy from us, work with us on a fragrance project, or contact us by email, form, phone or WhatsApp.

Last updated 5 October 2026

1. Who is responsible for your data

Avilés Fragrances is an independent perfume studio based in County Kerry, Ireland. Avilés Fragrances is the data controller for the personal information described in this policy.

For privacy questions, access requests or deletion requests, contact luis@avilesfragrances.com.

2. Information we may collect

Depending on how you interact with us, we may collect:

  • Your name, email address, phone number, billing or delivery details.
  • Enquiry, consultation and project information, including scent preferences, dislikes, memories and feedback you choose to share.
  • Health, allergy, sensitivity or accessibility information you voluntarily provide where it is relevant to a fragrance service or appointment.
  • Order, payment and transaction information. Card details are processed by our payment provider and are not stored by Avilés Fragrances in full.
  • Messages and communication history, including email and WhatsApp communications.
  • Website and technical information such as browser type, device information, pages visited, IP address and diagnostic or security information.
  • Consent choices, including marketing, photography, recording and WhatsApp preferences where relevant to a project.

3. Why we use personal data

We use personal data only where there is a valid reason to do so. This may include:

  • Responding to enquiries and arranging consultations.
  • Creating, managing and delivering bespoke perfume, space scent, product and community projects.
  • Processing orders, payments, deliveries, refunds and accounting records.
  • Keeping project notes and communication records so we can provide continuity and support reorders.
  • Sending practical updates you have asked to receive, including WhatsApp messages.
  • Sending marketing only where you have consented or where otherwise permitted by law.
  • Maintaining website security, preventing misuse and understanding basic site performance.
  • Meeting legal, tax, regulatory and safety obligations.

4. Legal bases

Our legal basis will depend on the context. We may process information because it is necessary to perform a contract with you, because you have asked us to take steps before entering a contract, because we have a legitimate business interest, because we have a legal obligation, or because you have given consent.

If you choose to provide health-related information, such as allergies, sensitivities or migraine information, we use it only for the purpose you gave it to us and, where required, on the basis of your explicit consent. You can withdraw consent at any time.

5. WhatsApp communications

If you contact Avilés Fragrances on WhatsApp, or opt in to practical WhatsApp updates, we may process your phone number, WhatsApp profile name, message content and message status information through WhatsApp Business and Meta services.

We use this information to reply to you, arrange appointments, send practical project updates you requested, and maintain an appropriate communication record. We do not use the content of your WhatsApp conversations for unrelated advertising, and we do not sell your WhatsApp data.

You can ask us to stop sending WhatsApp updates at any time.

6. Service providers

We use trusted service providers to operate parts of the business. Depending on the service you use, these may include Base44 for website and application infrastructure, Meta and WhatsApp for messaging, Stripe for payments, Google services for email, calendar and business administration, and Resend for transactional email.

These providers process information only for the services they provide to us and are subject to their own contractual, privacy and security obligations.

7. International transfers

Some service providers may process data outside Ireland or the European Economic Area. Where data is transferred internationally, we rely on recognised legal safeguards where required, such as adequacy decisions or approved contractual protections.

8. How long we keep information

We keep personal data only for as long as it is reasonably needed for the purpose it was collected, for an ongoing client relationship, or to meet legal and accounting requirements.

  • Enquiries that do not become projects are generally reviewed for deletion or anonymisation within 24 months.
  • Client and project records may be retained while the relationship remains active and for a reasonable period afterwards so we can support follow-up work and reorders.
  • Financial and transaction records may be retained for the period required under Irish tax and accounting law.
  • Marketing details are kept until you unsubscribe or withdraw consent.

9. Cookies and website data

The website may use essential cookies or similar technologies for functions such as security, authentication, shopping features and session management. We may also process limited technical and usage data to maintain the site and understand performance.

If we introduce non-essential cookies that require consent, we will provide the appropriate notice and controls.

10. Your rights

Under data protection law, you may have the right to access your personal data, correct inaccurate information, request deletion, restrict or object to processing, receive certain data in a portable form, and withdraw consent where consent is the legal basis.

You also have the right to make a complaint to the Irish Data Protection Commission. You can find information at dataprotection.ie.

11. Data deletion requests

To request deletion of personal data held by Avilés Fragrances, email luis@avilesfragrances.com with the subject “Data deletion request”.

Please include enough information for us to identify the relevant account, enquiry, order or conversation. We may need to verify your identity before deleting information. We will delete or anonymise data where we are legally able to do so. Some records may need to be retained where required by law or for the establishment, exercise or defence of legal claims.

12. Security

We use reasonable technical and organisational safeguards to protect personal data, including controlled access, encrypted service credentials and restricted administrative access. No online system can be guaranteed completely secure, so we review our systems and access arrangements as the business develops.

13. Changes to this policy

We may update this policy when our services, legal obligations or technology change. The current version will always be published on this page with the date of the latest update.
